Your Insurer may terminate your benefits on many grounds. The Insurer’s ability to terminate benefits arises from the terms of your policy of insurance. Policies vary and must be reviewed carefully. We recommend having your policy reviewed by a lawyer to ensure that your rights are protected.
The most common reasons for terminating benefits are:
1. Failure to provide medical records
2. Failure to provide updated medical records
3. Failure to be under the ongoing care of an appropriate medical professional for the symptoms of your disability
4. Failing to avail yourself for the insurer’s vocational rehabilitation program even if your treating physician has advised against it.
The insurer may also review the medical records your physician has provided and make their own assessment that you are able to return to your own pre-disability position believing you are able to perform substantially all of the key elements of your job notwithstanding you have substantial ongoing symptoms.
You have an ongoing obligation to keep your insurer advised of your medical status and to provide the insurer updated medical records. It is important that you see your treating physician very regularly. It is important that you ask your treating physician if referral to a specialist would be appropriate. If your insurer requests that you attend its rehabilitation program please seek a medical opinion from your treating doctor immediately and prior to attending.
If your treating physician’s recommends that you do not attend the rehabilitation program you must advise your insurer. The insurer is likely to maintain its demand that you attend the rehabilitation program even though your physician advises you against it. Failing to attend the rehabilitation program may result in termination of benefits. This is a common tactic of the insurer. Seek legal advice immediately. The Court takes a negative view of this tactic. You need a knowledgeable disability lawyer to assist you.
